SPECIAL TERMS AND CONDITIONS OF USE

These Special terms and conditions cover the access and terms of use of the Bookings section of the www.port-de-roanne.fr website. They complete and form an integral part of the General terms and conditions of use of the website, which the Client acknowledges having read, understood and accepted.

 

The applicable terms are those available on-line on the date of consultation.

 

1 • TERMS OF ACCESS TO THE BOOKING SECTION:

The Booking section lets the Website User submit an on-line request to book a berth at Roanne marina. This Service is provided free-of-charge and can be accessed at www.port-de-roanne.fr 24 hours a day, 7 days a week, within the limits set out in the General terms and conditions of Website use.

 

To access the Service, the Client must have use of a computer and a properly configured internet connection and browser.

 

2 • BOOKING REQUEST PROCEDURE:

The User can access an on-line booking request form in the Prices and Booking section, via the home page of the www.port-de-roanne.fr Website.

 

In the Booking section used to request a berth at the marina, the User must complete all the mandatory fields, namely:

– Your contact details:

  • Full name, telephone number and e-mail address

– Information on the boat:

  • Boat name, type, length, width, draught, vertical clearance, a photo of the boat,

–        Concerning the booking:

  • Preferred mooring, booking formula required and arrival date required

 

It will not be possible to process incomplete booking requests.

 

The following fields are optional:

– Your contact details:

  • address, post code, town

–        Concerning the booking:

  • Probable departure date,
  • Services required (water, electricity, telephone private EDF electricity meter)
  • Marina resident (occasional, permanent, non-resident)

 

Before validating the mandatory fields, the User will acknowledge having read and accepted all the General terms and conditions by checking the box next to “I accept the General terms and conditions of use of the www.port-de-roanne.fr Website”.

 

To finalise this stage of the booking procedure, the User will click on “Confirm”.

 

3 • FIELDS IN THE BERTH BOOKING SECTION:

The berth booking Service available in the Booking section is free-of-charge.

 

The fields to be completed by the User are essential in processing the booking request. The information requested is therefore mandatory, except for the postal details, the departure date, the services required and the Marina Resident status.

 

The User is informed that the on-line booking request procedure described does not imply immediate booking.

 

The booking is only effective after telephone contact and e-mail confirmation from the marina’s Harbour Master.

 

4 • CUSTOMER COMMITMENTS:

When using the Booking section, the User undertakes to:

 

• provide accurate, complete information when registering for the Service and whenever s/he uses it. The User remains solely responsible for the accuracy of the personal information entered.

• not to hinder or disrupt the smooth running of the Booking section

• not to transmit any element likely to contain a virus or anything else which might damage, intercept or interfere with all or part of the Website

 

Moreover, the User undertakes not to access or attempt to access or indeed use personal data belonging to other Users of the Website.

 

5 • GUARANTEES FROM LYONNAISE DES EAUX:

LYONNAISE DES EAUX France does not provide any express or implicit guarantee whatsoever regarding the use of the Booking section by the User.

 

Likewise, LYONNAISE DES EAUX France does not guarantee that the Content or the Services available on the Website will comply with the User’s expectations.

 

6 • FINANCIAL ASPECT:

The Booking section is provided free-of-charge to the User. However, internet access to connect to the Booking section remains at the User’s expense.

 

7 • PERSONAL DATA:

When using the Services available on the Website, the User expressly agrees that the following personal data will be collected by LYONNAISE DES EAUX FRANCE when s/he registers in the Booking

section:

– Your contact details:

  • Full name, telephone number and e-mail address

– Information on the boat:

  • Boat name, type, length, width, draught, vertical clearance, a photo of the boat,

–        Concerning the booking:

  • Preferred mooring, booking formula required and arrival date required

 

Other personal data may also be collected when using the Booking section, in particular the postal address, departure date, the services required and the Marina Resident status.

 

The User unreservedly accepts the collection and use of their personal data for the sole purpose of providing the Customer Service defined in these terms and conditions.

 

However, the User remains solely responsible for the data that s/he transmits within this framework.

 

In application of the provisions of the French Data Protection Act “Loi Informatique et Liberté” of 6 January 1978, LYONNAISE DES EAUX FRANCE strictly undertakes only to collect use and store the User’s personal data for the sole purpose of managing the Services offered, for a period of time equal to (but not exceeding) the time require to carry out the services for which it was collected or processed.

 

In accordance with the French Data Protection Act “Loi Informatique et Liberté” of 6 January 1978, the User has a right to access, change, rectify and withdraw his or her personal information.

 

To exercise this right, the User can send a written request by post to LYONNAISE DES EAUX FRANCE, Tour CB 16 – 16 place de l’Iris, 92040 PARIS LA DEFENSE CEDEX.

 

8 • APPLICABLE LAW:

These Special Terms and Conditions of use are subject to French law.
